Last Friday Governor Murphy signed Executive Order 23 directing the Department of Environmental Protection (DEP), with support from other state agencies, to develop guidance on how all state departments can incorporate environmental justice considerations into their actions. Environmental justice touches a wide variety of issues related to quality of life, including housing, health, and transportation. The text of the Executive Order can be found here.

The initial draft recommendations are due to the Governor within six months. The Environmental Justice Advisory Council (“EJAC”) created within the Department of Environmental Protection was set to expire at the end of the year, but the Governor continued its existence and provide guidance to departments related to the orders set forth in the executive order. A final set of recommendations will be enforced across the board at the agencies and departments.

NJBIA encourages you to read the executive order and monitor the development of the recommendations as it may impact permits or regulatory decisions made related to sites near environmental justice areas.
