The New Jersey Department of Environmental Protection has revised its model fill ordinance for municipalities to adopt regulating the deposits of soil and fill material.

NJBIA Vice President of Government Affairs Ray Cantor said the updated document provides more exemptions for public and utility projects and projects with fill plans approved by zoning and planning boards, and allows DEP more flexibility to waive the need for testing of the fill material.

The revised ordinance also clarifies that material from a Class B recycling facility is exempt from permit requirements.
