Legislation (S-1766) that would greatly expand the amount of damages that can be awarded under the New Jersey’s Wrongful Death Act (N.J.S.A. 2A:31-1 et seq.) was posted for consideration in the Senate Budget & Appropriations Committee, but was held for consideration.

Under current law, damages are limited to economic or pecuniary damages. The proposed measure would add such intangibles as mental anguish, emotional pain and suffering, loss of society, and loss of companionship.

NJBIA will continue to oppose the bill.
