NJBIA on Monday thanked the 52 New Jersey legislators who stood up for the business community by rejecting the $1 billion retroactive increase in the corporate business tax. 

The controversial legislation was signed into law by Gov. Phil Murphy on Friday night just hours after having passed the Assembly (43-34) and the Senate (22-15-3).  All Republican legislators in the Senate attendance voted ‘no’, and a handful of Democratic legislators also opposed the short-sighted tax increase or did not vote ‘yes’ even though they were present. 

The bill, A-4704, raises the Corporation Business Tax from 9% to 11.5% of net corporate income over $10 million. The new surcharge, purportedly for NJ TRANSIT, is a $1 billion tax retroactive to Jan. 1, 2024, even though the mass transit agency does not face a deficit until July 1, 2025. 

“This unfair and retroactive tax increase is bad for our state economy, our businesses and ultimately the workers they employ, and it will also hurt the consumers who purchase their goods and services,” NJBIA Chief Government Affairs Officer Christopher Emigholz.  

“We thank all those legislators who understood that and had the courage to stand with the business community by voting ‘no’ or avoid voting ‘yes’ on this tax,” Emigholz said.
