Employers can continue using the latest Form I-9  to verify the identity and employment authorization of new hires through May 31, 2027, now that the U.S. Citizenship and Immigration Services has updated the form with the new expiration date. 

Newly downloaded forms will bear the 2027 expiration date, but for now, employers may continue using any previously downloaded or printed forms that bear the former July 31, 2026, expiration date.  

I-9 forms must be used for both U.S. citizens and non-citizens alike. A new hire must attest to their employment authorization on the form and present their employer with acceptable documents as evidence of identity and employment authorization. The employer must examine these documents to determine whether they reasonably appear to be genuine and relate to the employee, then record the document information on the employee’s Form I-9.  

Certain employers who choose to remotely examine the employee’s documentation under a DHS-authorized alternative procedure, rather than via physical examination, must indicate they did so by checking the box provided on the form.
