On Monday, December 5th, the Assembly Financial Institutions and Insurance Committee will consider, for discussion only, A-3620 (Pinkin).

The bill makes the following changes to the affidavit of merit statute:
Requires filing the affidavit at the same time as the complaint is filed;
Requires the affidavit specify the duty of care allegedly breached;
Revises the circumstances when the court may waive the same specialty or subspecialty requirements in medical malpractice actions; and
Codifies that the affidavit must also be provided to a business entity that is also a named defendant.
