Under a recently adopted law, persons engaged in the dirt recycling business must register with the DEP by Monday, April 20. The DEP will be extending this date, but will not be able to do so before the deadline passes. DEP is expected to issue a document next week that will apply retroactively.
DEP also hopes to clarify who needs to register. It is NJBIA’s position that the law did not change the status of self-generators, so construction and similar firms that merely move soil and other like materials that they themselves dig up are not subject to the new registration and licensing requirements.
