On Thursday, the New Jersey General Assembly passed S-1790 / A-2903 by a vote of 43-26-5. The Senate then concurred by a vote of 22-12. The bill now heads to the Governor’s desk for his consideration.
The bill would impose enhanced enforcement procedures, remedies, and a variety of administrative sanctions against employers for violating wage and hour laws.
NJBIA worked with a coalition of many other organizations to try and address significant concerns with the legislation. The bill, in its current form, would criminalize inadvertent wage and hour violations and hold businesses responsible for the actions of their contractors.

We, unfortunately, were not successful in obtaining amendments to the bill. We did, however, receive commitments from legislative leaders to work on ‘clean up’ legislation and to work with the Department of Labor on regulations as a means to address some of our concerns.
