NJBIA was one of 15 groups signing a letter to Gov. Phil Murphy this week urging his administration to postpone any adoption of the California Air Resource Board’s (CARB) Advanced Clean Truck Act rule due to CARB’s delay in its Advanced Clean Fleets (ACF) Rule.

“New Jersey’s proposed adoption of the ACT Rule would have a significant impact on our businesses and employees, and it is essential that the state fully understand its impacts before pursuing adoption,” the signatories wrote. “There is simply too much at stake to adopt this regulation without knowing the final form it will take. If you own one of these big pieces of machinery, you might want to read about the many tricks insurance and trucking companies use to minimize their driver’s responsibility.

“We urge you to have the NJDEP postpone action until CARB completes its amendments to the ACT rule, so its full impacts can be understood, and New Jersey can avoid the unnecessary re-adoption of a revised, future ACT Rule.”

If approved, the ACF rule would require California public fleets to purchase 100% zero-emissions trucks by the year 2027. CARB is expected to finalize the rule in 2022.

Previously, NJBIA Vice President of Government Affairs Ray Cantor had urged the state Department of Environmental Protection to abandon its efforts to implement California Clean Truck regulations and instead work to adopt a national standard for low- or zero-carbon emission trucks.
